Summary:
To amend the Lacey Act Amendments of 1981 to treat nonhuman primates as prohibited wildlife species.
 
AVMA Position:
The AVMA supports passage of this legislation.
 
Purpose
This Act would amend the Lacey Act Amendments of 1981 to treat nonhuman primates as prohibited wildlife species.
  • The Lacey Act Amendments of 1981 make it unlawful to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce any prohibited wildlife species.
  • The legislation does not apply to person(s) or agencies that are:
    • Licensed or registered, and inspected by the Animal and Plant Health Inspection Service or any other Federal agency with respect to that species;
    • State colleges, universities, or agencies, state -licensed wildlife rehabilitators, or state-licensed veterinarians;
    • Accredited wildlife sanctuaries that care for prohibited wildlife species (with restrictions) or have custody of the animal solely for the purpose of expeditiously transporting the animal to a person or agency described above with respect to that species.
 
Why AVMA Supports this Issue
Support of this bill is consistent with the AVMA's positions on, "Private Ownership of Wild Animals," and "Nonhuman Primates as Assistance Animals."
 
Known Opposition to the AVMA Position: None Known
 
Current Status:
S. 1498 was introduced on May 24, 2007 by Senator Barbara Boxer and referred to the Committee on Environment and Public Works. It was reported out of committee on July 31, 2007, and placed on the Senate Calendar on October 29, 2007.

H.R. 2964 was introduced on July 10, 2007 by Representative Eddie Bernice Johnson and was referred to the Committee on Natural Resources. On July 16, 2007, H.R. 2964 was referred to the Subcommittee on Fisheries, Wildlife, and Oceans and a Subcommittee Hearing was held on March 11, 2008. It was reported out of the Subcommittee on June 4, 2008 and passed the House on June 17, 2008 by a vote of 302-96.
