H.R. 1398/S.807 AGRICULTURE PROTECTION AND PROSPERITY ACT

| Summary: |
| Amends the "Superfund" Act to provide that manure is not considered a hazardous substance, pollutant, or contaminant. |

| Purpose |
- Defines manure as any digestive emissions from livestock along with any associated bedding
- Exempts manure from being a hazardous substance, contaminant, or pollutant
- Exempts releases associated with manure from the emergency notification requirements of the Superfund Amendments and Reauthorization Act of 1986.

| Why AVMA Opposes this Issue |
| Superfund laws were created in the 1980s to provide for clean-up of industrial toxic waste sites and chemical spills. Opponents of animal agriculture want to apply Superfund laws to livestock operations because of manure emissions. Some state and local authorities are seeking to extend the Superfund laws to apply to livestock and poultry operations for emissions or discharges from manure. The AVMA does not believe such an interpretation is supported by science or legislative history. However, Congress needs to confirm that it never intended to regulate manure as a toxic waste. |

| H.R. 1398 was introduced on March 8, 2007 by Rep. Collin Peterson (D-MN/7th) and referred to the Committee on Energy and Commerce as well as the Committee on Transportation and Infrastructure. On March 9, 2007 it was Referred to the Subcommittee on Environment and Hazardous Materials and the Subcommittee on Water Resources and Environment. S. 807 was introduced on March 8, 2007 by Senator Blanche Lincoln (D-AR) and was referred to the Committee on Environment and Public Works. |
